SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price displayed at the time your order is placed and will be confirmed in your order confirmation.

All prices are displayed in Australian dollars (AUD) and include applicable taxes where required by law. Any applicable shipping charges will be clearly displayed during checkout before you complete your purchase.

From time to time, we may offer promotions or discounts that are subject to separate terms and conditions. If there is a conflict between the terms of a promotion and these Terms of Service, the promotional terms will apply to that promotion.

You agree to provide current, complete and accurate purchase, payment and account information for purchases made through our store.

SECTION 5 – SHIPPING AND DELIVERY

We aim to process and dispatch orders as quickly as possible. Any shipping or delivery timeframes provided by Wilde Baby Co are estimates and may be affected by circumstances outside our reasonable control, including carrier delays, weather events and other disruptions.

Nothing in this section limits any rights or remedies you may have under the Australian Consumer Law.

SECTION 6 – INTELLECTUAL PROPERTY

Our Services, including but not limited to our trademarks, brand names, logos, text, photographs, images, graphics, product reviews, video, audio, website design and other content, are owned by or licensed to Wilde Baby Co and are protected by Australian and applicable international intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. Unless permitted by law or with our prior written consent, you must not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit material from the Services.

Nothing in these Terms grants you any licence or other right to use the intellectual property of Wilde Baby Co, Shopify or any third party except as expressly provided.

Wilde Baby Co’s names, logos, product names, designs and branding may be trademarks or other intellectual property belonging to Wilde Baby Co. They must not be used without our prior written permission.

Shopify’s name, logo and related trademarks belong to Shopify. Other names, logos and trademarks appearing through the Services belong to their respective owners.

SECTION 16 – DISCLAIMER OF WARRANTIES

Information presented through the Services is provided for general information purposes.

To the maximum extent permitted by law, and except where expressly stated by Wilde Baby Co, we do not provide warranties or representations beyond those required by applicable law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights available to consumers under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

SECTION 17 – LIMITATION OF LIABILITY

To the maximum extent permitted by law, Wilde Baby Co and its officers, employees, contractors, service providers and licensors will not be liable for indirect, incidental, special or consequential loss arising from your use of the Services except where such liability cannot lawfully be excluded.

Nothing in these Terms excludes, restricts or modifies any right or remedy available to you under the Australian Consumer Law or any other applicable law where that right or remedy cannot lawfully be excluded, restricted or modified.

SECTION 22 – GOVERNING LAW

These Terms of Service and any separate agreements through which we provide Services are governed by the laws of Queensland, Australia, and the applicable laws of the Commonwealth of Australia.

You and Wilde Baby Co submit to the jurisdiction of the courts of Queensland and any courts having jurisdiction to hear appeals from those courts.

Nothing in this section limits any rights you may have under applicable consumer protection laws.
